PLEASE READ THESE VR3DPLAYER TERMS OF USE (“TERMS OF USE”) CAREFULLY TO UNDERSTAND YOUR RIGHTS AND OBLIGATIONS.
BY USING THE PRODUCT OR ANY EQUIPMENT OR SERVICES AVAILABLE WITHIN, YOU AGREE TO BE BOUND BY THESE TERMS OF USE.

THE VR3DPLAYER EQUIPMENT AND SOFTWARE IS FOR INDUSTRY PROFESSIONALS AND DEVELOPER USE ONLY AND IS NOT FOR PUBLIC AND OR CONSUMER LEVEL USE.

This product or products are still in development and are not to be considered a finished or complete product.
Changes to the hardware and or software are subject to change at any time.

You represent and warrant that you are of legal age and otherwise competent to be contractually bound by these Terms of Use.
If You are accepting these Terms of Use on behalf of Your employer, You represent and warrant that You have full legal authority to bind Your employer to these Terms of Use.

If You do not have the requisite authority, You may not accept these Terms of Use or use the Store or any Products on behalf of Your employer.

General Instructions & Precautions

You should always follow these instructions and observe these precautions while using the headset to reduce the risk of injury or discomfort:Use only in a safe environment: the headset produces an immersive virtual reality experience that distracts you from and completely blocks your view of your actual surroundings. always be aware of your surroundings when using the headset and remain seated at all times. take special care to ensure that you are not near other people, objects, stairs, balconies, windows, furniture, or other items that you can bump into or knock down when using—or immediately after using—the headset. do not handle sharp or otherwise dangerous objects while using the headset. never wear the headset in situations that require attention, such as walking, bicycling, or driving.
Make sure the headset is level and secured comfortably on your head, and that you see a single, clear image. Ease into the use of the headset to allow your body to adjust; use for only a few minutes at a time at first, and only increase the amount of time using the headset gradually as you grow accustomed to virtual reality. looking around when first entering virtual reality can help you adjust to any small differences between your real-world movements and the resulting virtual reality experience.

A comfortable virtual reality experience requires an unimpaired sense of motion and balance. do not use the headset when you are tired, need sleep, are under the influence of alcohol or drugs, are hung-over, have digestive problems, are under emotional stress or anxiety, or when suffering from cold, flu, headaches, migraines, or earaches, as this can increase your susceptibility to adverse symptoms.

Do not use the headset while in a moving vehicle such as a car, bus, or train, as this can increase your susceptibility to adverse symptoms.

Take at least a 10 to 15 minute break every 30 minutes, even if you don’t think you need it. each person is different, so take more frequent and longer breaks if you feel discomfort. you should decide what works best.

You should always remove the headset for any situation that requires attention or coordination.

Listening to sound at high volumes can cause irreparable damage to your hearing. background noise, as well as continued exposure to high volume levels, can make sounds seem quieter than they actually are. due to the immersive nature of the virtual reality experience, do not use the headset with the sound at a high volume so that you can maintain awareness of your surroundings and reduce the risk of hearing damage.

Discomfort
Immediately discontinue use if anyone using the headset experiences any of the following symptoms: seizures; loss of awareness; eye strain; eye or muscle twitching; involuntary movements; altered, blurred, or double vision or other visual abnormalities; dizziness; disorientation; impaired balance; impaired hand-eye coordination; excessive sweating; increased salivation; nausea; lightheadedness; discomfort or pain in the head or eyes; drowsiness; fatigue; or any symptoms similar to motion sickness. Just as with the symptoms people can experience after they disembark a cruise ship, symptoms of virtual reality exposure can persist and become more apparent hours after use. these postuse symptoms can include the symptoms above, as well as excessive drowsiness and decreased ability to multi-task. these symptoms may put you at an increased risk of injury when engaging in normal activities in the real world.
Do not drive, operate machinery, or engage in other visually or physically demanding activities that have potentially serious consequences (i.e., activities in which experiencing any symptoms could lead to death, personal injury, or damage to property), or other activities that require unimpaired balance and hand-eye coordination (such as playing sports or riding a bicycle, etc.) until you have fully recovered from any symptoms.

Do not use the headset until all symptoms have completely subsided for several hours. make sure you have properly configured the headset before resuming use.

Be mindful of the type of content that you were using prior to the onset of any symptoms because you may be more prone to symptoms based upon the content being used.

See a doctor if you have serious and/or persistent symptoms.

Health and Safety
There are important health and safety warnings and instructions that you must read before using the VR3DPlayer, which are available at VR3DPlayer.com. by using the VR3DPlayer, the store, and any products, you represent and warrant that you have read and understand these warnings and instructions. VR3DPlayer may update or revise these warnings and instructions, so please review them periodically. additional health and safety warnings and instructions may be provided by third party licensors in relation to their products.Use at Your Own Risk

Although it’s is rare it is possible to have negative health effects due to use or over use of the VR3DPlayer system.

Repetitive Stress Injury
Playing video games can make your muscles, joints or skin hurt. If any part of your body becomes tired or sore while playing, or if you feel symptoms such as tingling, numbness, burning or stiffness, stop and rest for several hours before playing again. If you continue to have any of the above symptoms or other discomfort during or after play, stop playing and see a doctor.

Radio Frequency Interference
The headset can emit radio waves that can affect the operation of nearby electronics, including cardiac pacemakers. If you have a pacemaker or other implanted medical device, do not use the headset without first consulting your doctor or the manufacturer of your medical device.

Health Risks Include
Nausea, Dizziness, Virtual Reality Sickness, Seizures, Addiction, Pathological and or Obsessive Behavior, Vision Problems, Carpal Tunnel, Migraines and or Death.
VR3DPlayer is not an anyway liable or at fault for any possible health risks that pertain to the use of our Head Mount Display or VR Software.

Children
This product should not be used by children under the age of 16.
Adults should monitor children (age 16 and under) who are using or have used the Headset and are experiencing any of the symptoms described above, and should limit the time children spend using the Headset and ensure they take breaks during use. Prolonged use should be avoided, as this could negatively impact hand-eye coordination, balance, and multi-tasking ability. Adults should monitor children closely during and after use of the headset for any decrease in these abilities.

Electrical Shock
To Reduce Risk of Electric Shock

Do not modify or disassemble any of the components provided.
Do not use the product if any cable is damaged or any wires are exposed.
If a power adapter is provided:
Do not expose the power adapter to water or moisture.
Unplug the power adapter before cleaning, and clean only with a dry cloth.
Keep the power adapter away from open flames and other heat sources.
Use only the power adapter and cable provided with the headset.

Sunlight Damage
Do not leave the headset in direct sunlight.
Exposure to direct sunlight can damage the headset and other components.

Disclaimer of Warranties.
To the maximum extent permitted by applicable law, the hardware, software, store, all products, and all paid points, reward points, and virtual items are provided “as is,” “with all faults” and “as available” and the entire risk of use and performance, remains with you.
VR3DPlayer and its suppliers and licensors do not make any representations, warranties, or conditions, express, implied, or statutory and hereby disclaim any implied warranties of merchantability, merchantable quality, fitness for a particular purpose, title, quiet enjoyment, or non-infringement. in particular, VR3DPlayer, its suppliers and licensors make no warranty that the store, any products available within, or any paid points, reward points, or virtual items: (i) will meet your requirements or will work with any third-party hardware, software, applications or third-party services; (ii) will be available or provided on an uninterrupted, timely, secure or error-free basis; (iii) or any information or content obtained through it will be accurate, complete, or reliable; or (iv) or that any defects or errors therein will be corrected. all products, paid points, reward points, and other material you download or access and use through the store are accessed at your own risk, and you will be solely responsible for any damage or loss that results there from. installation of products may affect third-party hardware, software, applications, devices, or services. you may have additional rights under your local laws that these terms of use cannot change. in particular, to the extent local legislation implies statutory terms which cannot be excluded, those terms are deemed incorporated into these terms of use but VR3DPlayer liability for a breach of those statutory implied terms is limited in accordance with and to the extent permissible under that legislation.
limitation of liability and exclusive remedies.
To the maximum extent permitted by applicable law and to the extent they are not excluded or disclaimed under this section 24, VR3DPlayer and its suppliers’ and licensors’ maximum, aggregate liability to you, and your exclusive remedy under these terms of use for any and all damages, injuries, and losses arising from any and all claims and causes of action arising out of, based on, resulting from or in any way related to these terms of use, the store, any products available.

GENERAL PROVISIONS

Waiver of Jury Trial IF A DISPUTE BETWEEN YOU AND VR3DPLAYER PROCEEDS IN COURT RATHER THAN OR IN ADDITION TO IN ARBITRATION, YOU AND VR3DPLAYER UNCONDITIONALLY WAIVE ANY RIGHT TO TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTER CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OF USE.

 Governing Law

The Federal Arbitration Act (the “FAA”) applies to the agreement to arbitrate. Except as preempted by FAA, the law of the State of Washington, without reference to its choice of laws principles, shall govern these Terms of Use. Notwithstanding the foregoing, the laws of Your state of residence in the U.S.A., (or if You live outside of the U.S.A. but within North or South America, the law of the country where You live), will apply to any court claims and/or any claims under any consumer protection statutes.

Severability

Except as specifically provided above, if any provision of these Terms of Use are held to be invalid or unenforceable, such invalidity or unenforceability shall not affect the enforceability of the remainder of these Terms of Use.

COPYRIGHT NOTICE AND TAKEDOWN PROCEDURES

You agree to respect the intellectual property rights of VR3DPlayer and third parties. If You believe that material available through the Store infringes the copyright of any third party, please notify VR3DPlayer copyright agent by using the notice procedure described within the Copyright link on the Store website. After receiving notice, VR3DPlayer may remove or disable access to any potentially infringing material. VR3DPlayer has the right to terminate any account or right of access to the Store for infringement by the account holder, or person accessing the Store, of VR3DPlayer or others’ rights.

LEGAL EFFECT

These Terms of Use do not change Your rights under the laws of the country in which You reside if the laws of Your country do not permit it to legally change Your rights.
You may have rights under the laws of the country in which You reside that are in addition to, or different from, the rights set forth in these Terms of Use.

COMPLIANCE WITH LAW; EXPORT REGULATIONS

You will comply with all national and international laws, rules and regulations that apply to the Store and any Products and Your use of the Store and any Products, (to which the they are subject), as well as end-user, end-use, and destination restrictions issued by U.S. or other governments.

ENTIRE AGREEMENT
These Terms of Use, and any Additional Terms, comprise the entire agreement for the Store.
